2025 ECCHO Rules Update

The 2025 version of the ECCHO Rules are now available online. The following ECCHO Rule changes were implemented on March 1, 2025.

  • Section XV, which related to Imperfect Image Items, was deleted. 
    • This meant the definition of Imperfect Image Item could be deleted from section I.
    • References to section XV were deleted from sections XVII(C) and XVIII(G)(4).
    • Associated commentary relating to Imperfect Image Items or to section XV was also deleted.
  • A new defined term, Sufficient Copy, replaced the definition of Photocopy in section I.
    • The new term replaced other language in the following sections:  XII(C)(2), XIX(K)(5)–(8), XIX(N)(2)(b), and XIX(O)(3)(b).
    • Associated commentary referring to the former term Photocopy was deleted, and commentary was otherwise revised to refer, where appropriate, to the new term Sufficient Copy. 
  • Section XII(C)(2)(a) was revised to use the defined term Electronic Returned Check. 
    • Certain cross-references in sections XIX(O)(3)(b)–(c) and XIX(O)(11)(b) were corrected, and a reference to Sending Bank in section XIX(O)(1)(c) was changed to refer to Depositary Bank.
  • Commentary to section XX(F) was revised to correctly describe commentary to section XIX(G)(4) as referring to a request for a second transmission, provision, or making available of Electronic Checks rather than simply copies of items.
  • Exhibit I:  Adjustment Matrix
    • The new defined term Sufficient Copy replaced references to “copy of item.”
  • Exhibit V:  Exhibits Related to Rules in Section XIX(N) and XIX(O)
    • The instructions for the Rule 8 and Rule 9 disclaimer forms were revised to use the new defined term Sufficient Copy and to refer to the Depositary Bank rather than the Sending Bank.
    • The sample letter to make a Rule 9 claim was revised to use the new defined term Sufficient Copy.  
  • Exhibit VII:  Returning Checks
    • The section on notice in lieu of return was revised to more closely track Regulation CC and its commentary.
